Big Sipz Parent Company Wins Patent Ruling Against BuzzBallz

The parent company of Big Sipz, best known for its 1-liter “Jugz” products, has won two challenges against BuzzBallz beverage container patents, according to final rulings issued by the U.S. Patent and Trademark Office’s Patent Trial and Appeal Board.
The PTAB issued Final Written Decisions finding all 26 claims across BuzzBallz U.S. Patent Nos. 11,738,904 and 11,932,441 invalid, MPL Brands NV Inc., doing business as Patco Brands, shared with The Daily Pour.
Patco Brands challenged the patents after BuzzBallz asserted them in a dispute related to beverage container design. In its rulings, the PTAB agreed with Patco Brands’ arguments and invalidated every claim in both patents.
“The PTAB’s decisions confirm that both patents BuzzBallz asserted against Patco Brands are invalid,” Kelly Patane, chief legal officer of Patco Brands, said in a news release. “These decisions represent important milestones for Patco Brands, reinforcing that our company acts appropriately and in compliance with intellectual property laws. We are confident that BuzzBallz’s claims should never have been brought.”
The PTAB’s decisions are final written rulings, which can be appealed to the U.S. Court of Appeals for the Federal Circuit.
Patco Brands is a privately held beverage company based in Sausalito, California. Its portfolio includes nationally distributed brands such as Rancho La Gloria and Dough Ball Whiskey.
