Kylie Minogue Considers Suing Aldi Over ‘Imposter’ Wine That Looks Eerily Similar to Her Rosé

The Daily Mail reported on Sunday that “Can’t Get You Out Of My Head” singer Kylie Minogue is considering legal action against German supermarket Aldi after it released a rosé that looks strikingly similar to the pop star’s sparkling rosé wine.

“It’s obvious to everyone what they are trying to do,” a team member from Minogue’s winery’s team said in a statement to The Daily Mail. “It is duping plain and simple.”

The Daily Mail reports that the “imposter” retails for £8.49 ($10.70) a bottle, whereas Kylie Minogue’s wine sells for over £9 ($11.30).

Aldi’s wine is called Rosalie Côtes de Provence Rosé, and according to the British outlet, the German supermarket is admitting that the wine’s packaging is “a dead ringer” for Kylie Minogue’s rosé.

One of Aldi’s spokespeople claimed that Master of Wine Sam Caporn blind-tasted the rosés side by side and claimed they were “completely identical.”

“We offer our customers products that match the quality of leading brands, but for a fraction of the price and go to great lengths to ensure that all our products adhere to strict copyright guidelines,” an Aldi spokesperson said to The Daily Mail in a statement.

Bitter Bottle Battles and Copyright Infringement

Similar cases exploring the murky territory of copyright infringement have surfaced within the beverage industry, like the case between Diageo’s Bulleit Frontier Whiskey and W.J Deutsch & Sons’ Redemption bourbon.

The bottles were undeniably similar, yet in June 2022, the verdict was mixed. The judge ruled the bourbon bottle did not violate Diageo’s Bulleit trademark rights and awarded the spirits mega-retailer the $21 million in damages it sought.

Still, the New York jury did partially rule in favor of Diageo, claiming that the bottle still deserved trademark protection and that the Deutsch bottle did minimize its distinctive design. Diageo decided to continue pursuing legal action.

In February, Diageo emerged victorious and defended its win against W.J. Deutsch & Sons in the 2nd U.S. Circuit Court of Appeals in Manhattan, claiming that the bottle was “distinctive enough” to force the retailer to alter its branding for Redemption Whiskey.

Though Kylie Minogue’s team hasn’t made a definitive statement about whether the pop star’s brand will pursue legal action against the German retailer, a battle in the courts might be in the cards.

The Daily Mail reported that a Kylie Minogue Wines “insider” was “peeved” at the situation and “that legal action was being considered.”
