In several states across the United States, the specter of drunk driving looms large, significantly contributing to fatal accidents. Recent research conducted by California-based criminal defense law firm Simmrin Law Group has highlighted the states grappling with the highest drunk driving rates, painting a concerning picture of road safety.

Simmrin Law Group’s analysis delves into the latest available data from the Fatality Analysis Reporting System. The findings shed light on the prevalence of alcohol-influenced drivers in fatal accidents between 2017 and 2021.

According to the study, Montana stood out with 31.42% of drivers involved in deadly crashes being under the influence of alcohol, a statistic unmatched by any other state. South Dakota secured the second spot with 25.31% of drivers in fatal accidents having alcohol in their system, with 2020 standing out as a year with the highest number, 51, of such incidents.

Wyoming followed with 21.69% of drivers in fatal crashes breaching the legal alcohol limit, per the data.

Vermont ranked fourth in the study, with 21.5% of drivers in deadly crashes found to have consumed alcohol. Meanwhile, North Dakota held the fifth position, with over one in five drivers in fatal crashes having consumed alcohol before the incident. Out of a total of 690 drivers involved in deadly road accidents in the state, 142 were found to be under the influence of alcohol, accounting for a rate of 20.58%.

At the other end of the spectrum, Mississippi boasts the lowest percentage of drunk drivers in fatal accidents, standing at a comparatively lower 6.97%. New York exhibited the second lowest incidence of drunk drivers in fatal crashes, amounting to 7.59% of the total (525 out of 6,920). Finally, Illinois was reported as having the third lowest rate, standing at 8.1%.

“Everyone knows that driving under the influence of alcohol is extremely dangerous and poses significant risks to both the driver and others on the road,” a spokesperson for Simmrin Law Group said, commenting on the data.

“Unfortunately, however, that has not prevented a significant amount of fatal accidents where the driver had been drinking. On a national level, 13% of drivers involved in a deadly crash were found to have alcohol in their system – more than 35,000 people.”
